“In most family history investigations, researchers must rely on a ‘Best Evidence Report’ because Utopian Genealogical Research, for five and more generations earlier, is seldom possible. ‘Best Evidence Reports’ are simply using whatever secondary records can be found, such as bibles, diaries, journals, newspapers, account books, letters, etc., all validated to highest possible degree. 


Using formal logic, the ‘Best Evidence’ finding must be connected to primary record reality by a properly qualified rationale as to what the ‘Best Evidence’ is that exists. The result is an identification based on Circumstantial Evidence. Circumstantial Evidence is a combination of Primary Documentation and ‘Best Evidence’. “Without Best Evidence research it would be impossible to have any genealogical research of ancestries in the Colonial South because of the record destructions in Virginia and southwards by fires, the Revolution, and the Civil War.” [‘Best Evidence’ Genealogy When and Where Records No Longer Exist A Limited Statement By John Scott Davenport, Ph.D.] 


This research report, therefore, is a ‘Best Evidence Report’. It is based on a combination of plentiful Primary Documentation and Secondary Records. Elisabeth L. W. Salyer, in addition to the Salyers, compiled the "Early Arnett Families of Eastern Kentucky". She authoritatively described that the proband, our David Arnett ancestor in question, had a parentage, place of origin and birth unknown.” She described a point of confusion in the David Arnett quest. There were 2 David 2 Arnetts. The Salyer document stated that “both David Arnetts that migrated to Kentucky were contemporary. Both men settled in Kentucky at approximately the same time. 


But that a comparison of the records clearly revealed their difference. That difference has been difficult for researchers. For many years that clarity has been a challenge.” “She stated that the birth of David Arnett, our ancestor proband, was between 1735 to 1755 without certainty, however. The origin of our David Arnett ancestor, 

  •  who died in Knox county, Kentucky in approximately 1825 
  •  has been elusive  because of the Revolutionary War Pension Claim for the final pension payment made in Barren Co, KY Sept 18, 1832 
  •  made under the U.S. Revolutionary War Pension Act of June 7, 1832 
  •  which made no reference to the veteran’s wife or children 
  •  and the claim was made by living heir, David Arnett II, for the final payment because the veteran and wife were deceased. 
  •  Below you will find substantiating data that David Arnett II in Barren Co, KY was not the same person as David Arnett I, our ancestor proband, who died in Knox, Co, KY in ~ 1825 
  •  Census data reveals that applicant David Arnett II, Barren Co. KY was younger than David Arnett I Knox Co, KY. Not an exact contemporary. 
  •  David Arnett I, ancestor proband, was born June 18 1752 in Louisa County Virginia, as reported in indirect evidence by concluded David Arnett II, heir, who made the final Rev War Pension Application 
  •  and the date reported by another descendant on DAR Revolutionary War Service Record, in DAR Library. 
  •  Other source: David Arnett I, was born between 1743 and 1752 (TA )“ 
  • In the Green Bible the date of David Arnett I death was given as 12 Sep 1825. The age at death of 82 for David I reported by Thomas Arnett had him born 1743.”

  •  David Arnett II was born ~1765  On the Rev War Pension Claim in 1832 the veteran David Arnett I was listed age 82 and was therefore born in ~1751-1752 
  •  Revolutionary War Pension Claim submitted by son, David Arnett II, is “the date found in pension claim S14924 based upon service of said David Arnett m the Revolutionary War.” And stated “David Arnett I was born June 18 1752 in Louisa County Virginia, and while a resident of Louisa Co VA.”

  •  The military service in Capt. Mosby’s Company, Louisa Co. VA home address and allowance are correct In the pension 
  •  David Arnett II was concluded, in this compilation, the son or ancestor proband, David Arnett I 
  •  But the pension address was the son, David Arnett II, in Barren Co, KY and is incorrect for David Arnett I the veteran, because it is the address where the final pension claim was to be paid to David Arnett II, closest living heir,  Apparently, David Arnett II was born, according to census records that follow in this compilation, before marriage to Mary Shackleford in 1779, the first wife of David I. 
  •  “David Arnett I and James Green jointly purchased 180 acres of land in 1814; and in 1818, David sold his half to James Green. David signed his named and his wife, Letitia, made her mark.” 
  •  By 1820 David Arnett had moved in with his daughter Nancy Arnett and her husband James Green. He lived with them until his death in 1825. When he died, David deeded all his property to James and Nancy Green. [RootsWeb]

“David Arnett, married Martha Bibb, in 1720 in King William County, Virginia, after transported as a Jacobite prisoner, from Liverpool, England.” He was not a thief, but political, military prisoner. “He was father of James Arnett. David Arnett became a planter. His will is recorded in Book 2, Reel 1, Richmond, Virginia. The will was probated in King William Co, Virginia, 27 May 1737. The original was destroyed but a copy is in Louisa Co. because of the later settlement of another estate.” 


“David Arnett and Martha Bibb Arnett apparently had at least 3 children: James, Mary Ann, and Robert. James is well documented, the others are not.” “Some researchers identify David Arnett transported 1716 to Virginia as the David Arnot who was christened 19 June 1689 at Kinnell in Angus, Scotland to Robert Arnot and Agnes Carr.” “David Arnot grew up in Scotland, fought in the first Jacobite uprising and was taken prisoner by the English in the 1715 Battle of Preston. In Calendar of Virginia State Papers, Vol. 1: 1652 to 1781. Richmond, Va.: the state, 1875, pp. 185-186. Page: 186 The ship, the Elizabeth & Anne was being used in the slave trade at the time of the 1715 Jacobite rebellion. It's merchant owners thought they might be more highly rewarded by handling the "transport" of prisoners for the King. The arrangement was to take the prisoners on consignment and receive payment when a receipt for their delivery was presented to His Majesty's Court in London. Liverpool, England to Yorktown, Virginia 14 January 1716 8 Virginia- By his Majestys' Lieutenant Governor & Commander in Cheif of this Dominion- 


These are to certify that the above Lift of one hundred & Twelve Rebel Prisoners, Imported into this Colony in the Ship Elizabeth & Ann, of Liverpool, Edward Trafford Master, was taken (by my order) upon the arrival of the said Ship in York River by the officer of the Customs there, and contains the Names of all the Prisoners Imported in the said ship & that besides the said one hundred & twelve persons, the Master did Report that one other Prisoner by name Duncan Mackfale died at sea, which upon Examination of the other Prisoners appeared to be true-Given under my hand at Williamsburg this 14th day of January 1716-

These prisoners were probably some of the followers of the Pretender captured at Preston, and condemned to be transported to the Colony in Virginia, 14 January 1716 after having been carried to London for trial. 1801-1811 when he was declared tax exempt (meaning he was over sixty years old). Thus, David Arnett I was born ~ 1751 -1752 Q: If David Arnett I was 60 in 1811, when he became tax exempt in Knox Co, KY, how old would he be if alive in 1830 and 1831? A = 79 and 80 


If David Arnett II was 60 years old in 1830, David Arnett 1, if alive, would be about 19 years older (79) than David Arnett II, born in about 1770. It appears David Arnett I fathered David Arnett II between 1765-1770, before his marriage to Mary Shackleford, 25 Oct 1779, Louisa Co. VA.

James GREEN (Lewis J. , Lewis J. ) was born on 8 May 1783 in Washington County, Virginia. He died after 1860. BIRTH: Age in 1850 Harlan Co census is given as 66. 12 James married Nancy ARNETT daughter of David ARNETT and Letitia GREEN? in Russell County, Virginia. Nancy was born on 16 Oct 1787 in Virginia. James Green and Nancy Arnett Green had the following children:  i David GREEN ii Lewis D. GREEN iii Letitia GREEN iv Sarah GREEN v Elizabeth GREEN Rueben Arnett b. 1784 in Copper Creek, Russell, VA. He married Susanna Kilgore. who was born 1787 in Copper Creek, Russell, VA. Rueben Arnett is buried on Middle Fork, Magoffin County, KY. Rueben's homestead. It is located across from the Middle School off RT 30. Steven Arnett, mbmsr ancestor, b. 1780 d. 1853. He married Elizabeth Howard on Jan. 13, 1803. Elizabeth b. 1780. She was the daughter of Thomas Howard and Lettie Durham (Cherokee). 


Stephen Arnett was born in Virginia in 1782 and died 1853 (aged 70–71) Floyd County, Kentucky, Burial Jackson L. Arnett Cemetery Magoffin County, Kentucky, USA.  His father was David Arnett and mother Letitia Green. Stephen Arnett married Elizabeth Howard 1783-1860.  

 

William Wiley “Ole Wile” Arnett was the son of Stephen Arnett and Elizabeth Howard and born  1816 and died 5 Feb 1900 (aged 83–84) in Magoffin County, Kentucky.  “Ole Wile” Arnett is  buried in the Wiley Arnett Cemetery, Magoffin County, Kentucky. 


On January 5, 1844 in Floyd County, Kentucky  William Wiley “Ole Wile”  Arnett received license to marry Elizabeth "Betsy" Sizemore the daughter of  Cherokee Chief George "Goldenhawk" Sizemore and Sallie Anderson. "Betsy" was also the granddaughter of Cherokee Chief George "All" Sizemore and Agnes "Aggie" Shepherd.  


Augustus Arnett was born 2 July 1855 Floyd County, Kentucky, died July 1922 (aged 67) Magoffin County, Kentucky, was the Son of William Wiley Arnett and Elizabeth Betsey Sizemore. Augustus married Mattie Patrick in 1875, daughter of Reuben Patrick and Amanda Burns Hager. Augustus was a lawyer and according to his death certificate Cause of Death was cancer. Augustus is buried in the Bluegrass Cemetery, Salyersville, Magoffin County Kentucky.
